Wellbutrin Lawsuits

Drug manufacturers have a responsibility to provide a safe and effective product. London-based GlaxoSmithKline has already settled with victims in other cases, and now it appears the company could be in legal hot water once again. A new study by the American Journal of Obstetrics & Gynecology shows that a commonly used anti-depressant, Wellbutrin (or its generic version, Bupropion), could be linked to an extremely harmful birth defect.

The researchers stress that more examination is necessary, but the results are clearly disturbing for mothers with prescriptions for this drug. In past cases, GlaxoSmithKline has paid the following:

  • $750 million to users of Paxil due to "serious deficiencies in quality assurance," according to the Boston Herald
  • $63.8 million for misleading advertising about one of their drugs, according to The New York Times
  • $460 million to users of Avandia who suffered heart attacks and strokes, according to Reuters

The next big case against this pharmaceutical company could be for the issues with Wellbutrin. New research shows that infants of mothers who were taking the drug in the first trimester of pregnancy had double the risk of being born with a heart defect. Though these cases are rare, they lead to serious complications. The specific problem is a left outflow heart defect in infants, which often requires surgery.

Victims in this case could be entitled to a variety of compensation including reimbursement for medical bills, emotional anguish, travel expenses and other legitimate costs. Some victims are considering class action lawsuits against this giant drug manufacturer. In these cases, victims with similar claims band together, splitting any settlement depending on the severity of their individual damages.

These plaintiffs believe the company should be held accountable for designing, marketing and selling a dangerous product. While there are a number of minor side effects associated with many prescription drugs, no one assumes that it could be harming a child. The drug is also used as a smoking cessation aid, known as Zyban, which soon-to-be mothers probably took to ensure their unborn children were healthy.
